Purposes and legal bases for the processing of personal data

The purpose of the processing is to fulfill the public tasks assigned to us by the legislator. Unless otherwise stated, the legal basis for the processing of your data results from Article 4 (1) of the Bavarian Data Protection Act (BayDSG) in conjunction with Article 6 (1) letter e of the General Data Protection Regulation (DSGVO). Accordingly, we are allowed to process the data required to perform a task that is our responsibility. Insofar as you have consented to processing, data processing is based on Art. 6 section 1 letter a DSGVO.

Your data will possibly be transmitted to the responsible supervisory and auditing authorities to exercise the respective control rights.

To prevent threats to security in information technology, log data can be forwarded to the State Office for Security in Information Technology based on Art. 12 of the Bavarian E-Government Act (for more information, see "Logging").

Duration of storage of personal data

Your data will only be stored for as long as is necessary to fulfill the task in compliance with statutory retention periods.

Rights of the data subject

Insofar as we process personal data about you, you as the data subject have the following rights:

  • If your personal data is processed, you have the right to receive information about your personal data (Art. 15 DSGVO).
  • If incorrect personal data is processed, you have the right to have it corrected (Art. 16 DSGVO).
  • If the legal requirements are met, you can request that the processing be deleted or restricted, and you can object to the processing (Art. 17, 18 and 21 DSGVO).
  • If you have consented to the processing or there is a contract for data processing and the data processing is carried out using automated procedures, you have the right to data portability (Art. 20 DSGVO).
  • If you have consented to the processing and the processing is based on this consent, you can withdraw your consent at any time for the future. This does not affect the lawfulness of data processing based on consent until its revocation.

Logging

When you access this or other websites, you transmit data to our web server via your internet browser. The following data is recorded during an ongoing connection for communication between your internet browser and our web server:

  • date and time of the request
  • name of the requested file
  • the page from which the file was requested
  • access status (file transferred, file not found, etc.)
  • web browser and operating system used
  • complete IP address of the requesting computer
  • amount of data transferred

For technical security reasons, in particular to prevent attempts to attack our web server, we store this data. After seven days at the latest, the data is anonymized by shortening the IP address at the domain level, so that it is no longer possible to establish a reference to individual users. To prevent threats to security in information technology, this data is forwarded to the State Office for Security in Information Technology on the basis of Article 12 of the Bavarian E-Government Act.

Integration of YouTube videos 

Videos from the external video platform YouTube are integrated on our website. By default, only the preview image of the respective videos is accessed and no further content is loaded or data is exchanged with YouTube. Only with your consent will the associated videos be integrated on our site and a conventional connection established with the YouTube servers.

We do not use programs to evaluate user behavior.

Acquisition of further data

If you enter personal or business data (e-mail addresses, names, addresses, etc.) on our website, these will only be used to send the requested information or for the purposes stated in the form. Your data will be encrypted during transport using software (SSL) and are protected from third parties. The data will not be shared with third parties. The services offered there are used on a voluntary basis.

Electronic mail (email)

Information that you send to us in unencrypted form by electronic mail (e-mail) may be read by third parties during transmission. As a rule, we cannot verify your identity and do not know who is behind an email address. A legally secure communication by simple email is therefore not guaranteed. Like many e-mail providers, we use filters against unwanted advertising ("SPAM filters"), which in rare cases also erroneously automatically classify and delete normal e-mails as unwanted advertising. Emails that contain harmful programs ("viruses") are automatically deleted by us.

If you want to send us sensitive messages, we recommend encrypting and signing them in order to prevent unauthorized access and falsification during transmission or to send the message to us by conventional mail.

 You can call up the required PGP communication key (public key) from the central PGP key server of the Bavarian network of authorities at the address "pgp-keyserver.bayern.de". Information on the "GpG4Win" encryption software, which can be downloaded free of charge and was developed on behalf of the Federal Office for Information Security, is available on the website www.gpg4win.de. The establishment of PGP for communication with the Bavarian administration is described in more detail in the brochure (PDF) available there.

Please also let us know if and how we can send you encrypted e-mails to answer your mail. If you have no way of receiving encrypted e-mails, we ask you to give us your mailing address in order to answer your messages worthy of protection.
